| DoC Confirms Indonesia's Plastic Bags Dumping |

Washington, Business Wire -- The U.S. Department of Commerce has issued affirmative final determinations in the antidumping duty investigations of imports of plastic grocery and shopping bags (referred to as polyethylene retail carrier bags) from Indonesia and Vietnam and in the countervailing duty (anti-subsidy) investigation of plastic bags from Vietnam. This marks the first time that the United States has applied its countervailing duty law to Vietnam.
The final dumping margins calculated by Commerce range from 69.64 percent to 85.17 percent for the Indonesian producers and from 52.30 percent to 76.11 percent for the Vietnamese producers. In addition, the final subsidy rates for the Vietnamese producers range from 0.44 percent to 52.56 percent. Today’s decision follows the announcement last week of final dumping margins on plastic bags from Taiwan ranging from 36.54 percent to 95.81.
Commerce initiated these investigations pursuant to a petition filed on March 31, 2009, by Hilex Poly Co., LLC, and Superbag Corporation. On May 14, 2009, the U.S. International Trade Commission (“ITC”) preliminarily determined by a unanimous vote that the domestic industry is materially injured by reason of dumped or subsidized imports from Indonesia, Taiwan, and Vietnam. The ITC is expected to announce its final decision on April 14.
If the ITC makes an affirmative final determination, Commerce will issue antidumping and countervailing duty orders directing U.S. Customs and Border Protection (“Customs”) to collect antidumping duty cash deposits on all imports of the subject bags from Indonesia, Taiwan, and Vietnam, and to collect countervailing duty cash deposits on all imports from Vietnam. For example, if an importer enters subject bags from a Vietnamese producer with a 76.11 percent dumping margin, the importer would have to pay an antidumping duty cash deposit equal to 76.11 of the customs value at the time of entry.
Petitioners’ legal counsel, Joe Dorn, of King & Spalding in Washington, DC, stated: ''The findings by Commerce today confirm the petitioners’ belief that imports from these three countries have been unfairly priced in violation of the rules of the World Trade Organization and U.S. trade statutes. The level of dumping found by Commerce is truly egregious. The petitioning companies and their workers greatly appreciate the actions taken by the U.S. government to offset unfair prices with antidumping and countervailing duties. The duties should help restore fair competition to the U.S. market and enable these companies to keep plants and jobs in the United States.''
The purpose of the antidumping and countervailing duty laws is to offset the unfair competitive advantage that foreign exporters enjoy as a result of selling merchandise in the United States at less than fair value or receiving subsidies from their governments. Customs will assess antidumping and countervailing duties on imports subject to the orders based on the following rates determined in the investigations:
